Leave Rules In Indian Railway Overview
Leave Rules in Indian Railway is called the Railway Services (Liberalised Leave) Rules, 1949. Indian Railway leave rules are governed mainly by:
- Railway Establishment Code (IREC, Chapter 5)
- Railway Board circulars
- 7th Pay Commission updates
These rules apply to:
- Permanent railway servants appointed on or after 1st February 1949
- Temporary staff
- Apprentices
- Running staff
- RPF personnel
The Railway administration aims to design the indian railway leave system to ensures that employees get sufficient rest while maintaining operational efficiency.
It is crucial to note that leave of any kind cannot be claimed as right. Moreover the leave of any kind may be refused or revoked by the authority competent to grant leave. However authority cannot alter the nature of leave applied by empolyee. Except as proved otherwise under leave rule any kind of leave may be granted in combination with any other kind of leave. No Railway Servant shall be granted leave of any kind for continuous period exceeding five years.

Types Of Leaves In Indian Railway

1. Leave On Average Pay (LAP) or Annual Paid Leave (APL) or Earned Leave (EL)
- Railway Servant shall be entitled to 30 days leave on average pay in a calendar year. It shall be credited in advance. It is credited in 2 installments of 15 days each on the 1st January and 1st July of every calendar year.
- LAP shall be credited at the rate of 2 1⁄2 days for each completed months.
- The maximum leave can be accumulated upto 300 days w.e.f. 01.07.1997 (RB No.
F(E)III/97/LE-1/03 dated 10.11.1997) + 15 of current half year. - Maximum leave may be granted 180 days at a time.
- If employee is on EOL/LWOP/Absent from duty during previous half year, the credit of next half year shall be reduced by 1/10 of the period of such absent/EOL subject to maximum 15 days in one half of the year. While affording credit of LAP fraction of day shall be rounded off to the nearest day (RBNo.E(P&A)1-96/CPC/LE-5 dated 07.02.1997).
- Railway Servant serving in Railway School shall be credited to 5 days each of the half
year on 1st January and 1st July of every calendar year. - In case of Railway Servant serving in Railway School, if the period is availed as EOL/Absent/Dies non the credit in next half year shall be reduced by 1/30 of the period of such EOL/Absent/Dies-non subject to maximum of 5 days.
- If School Teacher is appointed/ceases to be in service shall be allowed at 5/6 days for each completed month in the half year in which appointed.
- If Railway School staff avails portion of vacation he/she shall be entitled to LAP in such proportion of 30 days as the number of days of vacation not availed during full vacation.
- If Railway Servant does not avail himself any vacation, LAP shall be admissible to him maximum as due in that year under Rule 523/RI. Provided leave taken in conjunction shall not exceeds 300 days.
Leave on Averace Pay applicable to School Staff- (Revised in 7th CPC)
- The leave account of every Railway servant who is serving in a Railway School such as teacher, principal, headmaster, librarian, laboratory assistant or a waterman shall be credited with leave on Average Pay, in advance, in two installments of five days each on the first day of January and July of every calendar year.
- In respect of any year in which a Railway servant avails a portion of the vacation, he shall be entitled to additional leave on Average Pay in such proportion of twenty days, as the number of days of vacation not taken bears to the full vacation, provided the total Leave on Average Pay credited shall not exceed thirty days in a calendar year.
- If, In any year, the Railway servant does not avail any vacation, Leave on Average Pay will be as per Rule 523 instead of clauses (a) and (b).
2. Leave On Half Average Pay (LHAP)
- It can be granted to Railway Servants on half average pay other than Railway School/Staff.
- It shall be credited in leave account in 2 installments 10 days each of the half year on 1st January
- and 1st July in advance.
- The amount of LHAP can be availed in one spell combined with any other kind of leave or not shall be limited to 24 months.
- This leave may be granted on Medical Certificate or private affairs or at the request of employee.
- It can be accumulated in Leave Account unlimited.
- LHAP is not admissible to Railway School Staff. (RB No.E(P&A)1-92/CPC/LE-3 dated 04.12.1992)
- If an employee remain absent or under suspension and the period is treated as ―No work (without pay) than 1/8 of that number of days will be deducted from earning of LHAP. (RB No.E(P&A)1-85/JCM/NC/3 dated 09.03.1988)
Leave on half average pay (Revised in 7th CPC)
- A Railway servant, permanent or temporary otherthan one who is serving in a railway school, shall beentitled to Leave on Half Average Pay of 20 days inrespect of each completed year of service.
- The account of Leave on Half Average Pay of every Railway servant (other than a Railway servantserving in a Railway School) shall be credited withLeave on Half Average Pay in advance, in twoinstallments of ten days each on the first day ofJanuary and July of every calendar year.
3. Commuted Leave (COL)
- It can be granted on Medical Certificate to Railway Servants.
- If authority competent to grant such leave is satisfied that there is reasonable prospect of the Railway Servant returning to duty on its expiry.
- If authority competent to grant such leave is satisfied that there is reasonable prospect of the Railway Servant returning to duty on its expiry.
- No limit to the number of days of commuted leave to be availed during entire service.
- 180 days shall be allowed to be commuted during the entire service, in case (LHAP) only utilized for approved course of study and is certified to in the interest of Public interest.
- Where commuted heave has been sanctioned and employee retire/resign from service without returning the duty, the commuted leave shall treated as half average pay and difference between the leave salary be recovered.
- Provided that retirement is thrust upon employee compulsorily and due to ill health no leave salary shall be recovered.
- Commuted leave may be granted at the request of employee even LAP is due to him.
4. Extra Ordinary Leave (EOL) or LWP
- Extra Ordinary Leave may be granted to a Railway Servant when
- No other leave is admissible to railway Servant
- Other leave is admissible but the Railway servant applies in writing for the grant of extra ordinary leave.
- Unless the president in view of the exceptional circumstances of the case otherwise no temporary Railway Servant shall be granted EOL on one occasion is excess of three months to 24 months depending upon his sickness
- Two spells of EOL if intervened by any other kind of leave shall be treated as one continuous spell of EOL.
- No limit in case of permanent Railway Servant, but all kind If leave together, shall not be exceed 5 years in one spell at divisional or Railway level.
Grant of Extraordinary leave for study purpose of Probationers of Indian Railway Medical Service. (RB No. 2001/E/GR/11/7/13 dated 26.03.2004)
Probationers in Railway shall be entitled to leave under these rules as if he had held his post substantively otherwise than probationers provided that where such person already hold lien on permanent post before such appointment, he shall be entitled to leave under the rule as a permanent Railway Servant.
5. Leave Not Due (LND)
- Leave not due may be granted to permanent Railway Servants.
- LND shall be limited to leave half average pay which is likely to earn thereafter.LND during the entire service shall be limited to 360 days on Medical Certificate, out of which not more than 90 days at a time and 180 days in all in one spell.
- LND shall be debited against LHAP account and is likely to earn subsequently.
- Where Railway Servants who has been granted leave not due resign or retire voluntarily fro service without returning duty leave salary be recovered considering resignation or retirement is taking effect from the date on such leave had commenced.
- If employee retirement is compulsorily thrust upon him by reason of ill health and incapacitated Railway Servant for further service, no leave salary shall be recovered.

6. Maternity Leave
- A female Railway Servant with less than two surviving children may be granted maternity leave for a period of 180 days from the date of commencement.
- During such period she may be paid salary drawn equal to pay drawn before proceeding leave.
- In case of Mis-carriage/Abortion it can be granted for 45 days in entire carrier of service to female employee. The maternity leave may be supported by Medical Certificate on application. (Rly Board No.E(P&A)1-94/CPC/LE-6 dated 28.04.1997)
- In continuation of maternity leave any lease, LND upto 1 year, upto 60 days applied for and (incl. Commuted leave) may be granted without medical certificate.
- In addition to these on recommendation of Medical Attendant the leave can be granted for illness of females or new born baby.
- Maternity leave so granted may not be debited in leave account upto 135 days.
- Adopted mother may also be granted leave even without production of medical certificate as leave due and admissible not exceeding one year but this facility will not be available to adopted mother having two children‘s.
- The maximum admissible period of one year leave of the kind due will be reduced by the age of child.
- If child is less than one month, leave upto one year may be allowed.
- If child is six months old, the leave upto 6 months may be allowed.
- If child is nine months of more, leave upto 3 months may be granted.
- The maternity leave may also be granted to unmarried female railway servants.
7. Paternity Leave
- A Male Railway Servant with less than 2 surviving children may be granted paternity leave for a period of 15 days during the confinement of his wife.
- During the period of such leave he shall be paid leave salary equal to the pay drawn immediately before proceeding to leave.
- Paternity leave shall not be debited against the leave account and may be combined with any other kind of leave. (as in the case of maternity leave.).
- It may not normally be refused under and circumstance.
- Paternity leave to a male Railway Servant may be allowed in case of wife had given birth to the child on a date not prior to 180 days from the date of issue of this order i.e. 07.10.1997. (RB No.E(P&A)1-98/CPC/LE-6 dt. 21.05.1999 &dt. 01.10.1999
- The Ministry of Railways have decided that the limit of 22 years in case of a disabled child for the purpose of Child Care Leave under the provisions of Rule 551 (E) of Chapter-5 of Indian Railway Establishment Code (IREC), Volume-I be removed.
- It has also been decided that Child Care Leave may not be granted for a period less than five days at a time w.e.f.13th June, 2018. RBE 162/2018.
8. Child Care Leave (CCL)
- Subject to the provisions of this rule, a female Railway servant and single male Railway servant may be granted Child Care Leave by an authority competent to grant leave for a maximum period of seven hundred and thirty days during entire service for taking care of two eldest surviving children, whether for rearing or for looking after any of their needs, such as education, Sickness and the like.
- For the purposes of sub-rule (1), ―child means
- below the age of eighteen years; or
- an offspring of any age with a minimum disability of forty percent as specified in the Government of India in Ministry of Social Justice and Empowerment‘s Notification No. 16-18/97-N 1.1, dated the 1st June, 2001.
- Grant of child care leave to a female Railway servant and a single male Railway servant under sub-rule(1) shall be subject to the following conditions, namely:-
- (i) it shall not be granted for more than three spells in a calendar year;
- (ii) in case of a single female Railway servant, the grant of leave in three spells in a calendar year shall be extended to six spells in a calendar year.
- it shall not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority issatisfied about the need of Child Care leave to the probationer, provided that the period for which such leave is sanctioned is minimal.
- Child Care leave may not be granted for a period less than five days at a time.
- During the period of child care leave, a female Railway servant and a single male Railway servant shall be paid one hundred percent of the salary for the first three hundred and sixty five days, and at eighty percent of the salary for the next three hundred and sixty five days.
- Child Care Leave may be combined with leave of any other kind.
- Notwithstanding the requirement of productions of medical certificate contained in Rule 527 or sub· rule (1)(ii) of Rule 528, leave of the kind due and admissible (including Commuted leave not exceeding sixty days and Leave Not Due) upto a maximum of one year, if applied for, be granted in continuation with child care leave granted under sub-rule (1).
- Child Care l eave shall not be debited against the leave account. Explanation – ̳Single Male Railway Servant‘ means – an unmarried or widower or divorcee Railway servant.
9. Study Leave
- It is granted 12 months at a time and during entire services not more than 24 months in all.
- Doctors: If PG course, for medicine and research, it is granted for 36 months, with the personal approval of GM, above it leave is taken for higher study which will be help in Railway Working.
- Bond should be executed, that he will serve railway at least 3 year after expiry of such leave for every employee excluding Doctors.
- Doctors have to execute bond for 8 years.
- Leave salary in all courses in India & out of India, pay + DA only payable. Incurred in performance of official duty/ position.(RB No.F(E)III/89/LE-1 dated 23.06.1998).
- Provision of Study Allowance is deleted in 7th CPC.
10. WORK RELATED ILLNESS AND INJURY LEAVE (WRIIL)
The authority competent to grant leave may grantWork Related Illness and Injury leave {herein afterreferred to as WRIIL) to a Railway servant (whetherpermanent or temporary), who suffers illness or injurythat is attributable to or aggravated in theperformance of her or his official duties or inconsequence of her or his official position subject tothe provisions contained
in rule 521 of these rules, onthe following conditions, namely:
- Full pay and allowances shall be granted to allemployees during the entire period of hospitalizationon account of WRIIL.
- Beyond hospitalization, WRIIL shall be governed asfollows:
- A Railway servant (other than of RPF/RPSF) full payand allowances for the six months immediatelyfollowing hospitalization and Half Pay for twelvemonths beyond the said period of six months. The HalfPay period may be commuted to full pay withcorresponding number of days of Leave on HalfAverage Pay debited from the employees leaveaccount.
- For officers RPF/RPSF full pay and allowances for sixmonths immediately following the hospitalization andfull pay only for the next twenty four months.
- For personnel below the rank of officer of theRPF/RPSF full pay and allowances, with no limitregarding period.
- In the case of persons to whom the Workmen‘sCompensation Act, 1923 applies, the amount of leavesalary payable under WRIIL shall be reduced by theamount of compensation paid under the Act.
- No Leave on Average Pay or leave on Half AveragePay shall be credited during the period that employeeis on WRIIL.
